Portland Periodic Review

Background

The City of Portland's periodic review work program is organized to carry out the comprehensive plan update in three procedural phases - inventory, alternatives analysis, and policy choices and implementation. The inventory and alternatives analysis phases have been completed and approved by the Department of Land Conservation and Development (DLCD).

The city has submitted the final two tasks to DLCD for review.

Task 4, Policy Choices, includes the 2035 comprehensive plan map along with goals and policies related to the city's economic, housing, public facilities and transportation elements of the comprehensive plan.

Task 5, Implementation, is intended to carry out the policy decisions that are made in previous tasks.

Introduction/Timeline

The city submitted the final decision regarding Task 4 (Ordinance No. 187832) to DLCD on April 28, 2017 and waiver of DLCD's 120-day deadline for review on May 18, 2017. Portions of the submittal are included in the "Submittal" section below. DLCD received 10 objections to Task 4 (see "Objections," below).

The city submitted the final decision regarding Task 5 (Ordinance No. 188177) to DLCD on August 7, 2017. Portions of the submittal are included in the "Submittal" section below. Objection to Task 5 received by the department will be included in the "Objections" section below after the objection period closes on August 28, 2017.

DLCD reviewed the Task 4 and Task 5 submittals together. The director of DLCD approved the tasks on December 5, 2017. The approval order is available here.

Department Decision

The director of DLCD approved Portland periodic review tasks 4 and 5 on December 5, 2017. The approval order is available here. The approval order can be appealed to Land Conservation and Development Commission for review. Only those who submitted valid objections are eligible to appeal. See OAR 660-025-0150. Appeals must have been received by DLCD by December 26, 2017. See the order for more details.

 

Land Conservation and Development Commission Appeal Hearing and Decision

The commission will hold a hearing on the appeal of the director's decision to approve the City of Portland's Periodic Review Tasks 4 and 5 (Order 001892). These tasks amend and implement Portland's Comprehensive Plan by providing for future housing and employment development and ensuring that this development is provided with adequate transportation and other public facilities. The hearing will be conducted according to the procedures in OAR 660-025-0085 and 660-025-00160. The commission will decide the matter on the written record. Oral argument will be allowed at the hearing, but is limited to the City of Portland and the persons who filed a valid objection.
