Delegated Authority for Public Paved Roads



ODOT may delegate its authority, under Oregon Revised Statute 810.180, for public paved roads under the jurisdiction of the road authority. OAR 734-020-0013 describes the process and requirements ODOT must follow in order to delegate our authority to another road authority. The request for authority and establishment of speed zones on roads by road authorities will follow the processes and methodologies specified in OAR 734-020-0013 through OAR 734-020-0015.

When an agency makes this request, they become responsible for completing speed zone investigations and issuing speed zone orders on all paved roadways under their jurisdiction. The delegation covers all paved roadways under the requesting agency's jurisdiction.

Request Process

The request for delegated authority must be made to the state traffic roadway engineer. The request form is available in the Resources Section. As detailed on the request form and in OAR 734-020-0013, the request form must be submitted with all appropriate attachments and signatures.

The requesting agency must name a qualified, registered professional engineer to be responsible for decision making and assuring the agency follows all methods and procedures in the OAR. Anyone involved in the engineering study and speed zone order process must complete appropriate training and must read and understand the criteria listed in the associated OARs and Speed Zone Manual.
