How to determine home sale prices
The following rent and income limits are based on the
CDBG-DR 120% Income Limits published by HUD on June 1, 2025. Utility allowances must continue to be deducted from rents to achieve the maximum tenant rents allowed. Please note that all definitions and explanations herein may be subject to change upon later IRS and/or HUD clarification.

Originating Ordinance
After identifying the unique housing needs that would need to be factored into a local MIRL program, sponsoring jurisdictions establish local control by passing an originating ordinance. This ordinance should define local site approval, provide a draft of a compliance plan, and specify the utility allowance.

Initiate a master agreement
Before a sponsoring jurisdiction can submit a program loan request, they must adopt an ordinance or resolution and enter into a master agreement with OHCS. If the sponsoring jurisdiction is a city, an executed intergovernmental agreement (IGA) between OHCS and the county must be in place before a master agreement is executed with the city.
Note: An IGA with the county will be initiated by OHCS when the master agreement process is started by the corresponding sponsoring jurisdiction. Originating ordinances / resolutions must be adopted prior to initiating a master agreement.

File an Intent to Apply
Sponsoring jurisdictions will submit an Intent to Apply form upon provisional approval of a project application. The Intent to Apply notifies OHCS that the sponsoring jurisdiction wants to request a program loan from OHCS.
Note: An Intent to Apply will not be accepted unless the sponsoring jurisdiction has an executed master agreement with OHCS.

Pro Forma (including project costs, uses, and construction timeline) – These are different for rental vs. homeownership projects
- Site Control Verification:OHCS requires verification of sponsoring jurisdiction site control for MIRL projects. This can be provided through any of the following documents:
- Option to purchase
- Purchase and sale agreement
- Copy of the deed
- Appraisal
- Executed copy of the Master Agreement
- Ownership Integrity form: This form must be completed by the development project team certifying that members have not engaged in activities such as fraud, non-compliance, or bankruptcy that would disqualify them from receiving public funding for housing development. The form ensures the integrity and reliability of the team managing the project.
- BOLI prevailing wage determination letter
- OHCS requires all MIRL Projects to obtain a BOLI Determination Letter to be submitted with the Provisionally Approved Application. Please submit a written request for a determination to BOLI at
pwr.email@boli.oregon.gov. The BOLI website has more guidance on what to include in the request.
- Compliance narrative explaining how the compliance plan will be used for this project

Sponsoring Jurisdiction Annual Report
Sponsoring jurisdictions are required to submit an annual report and program of certificate of compliance to OHCS with updated financials and outcomes of their MIRL program annually.

Underwriting guidance: When a Sponsoring Jurisdiction reviews a MIRL project application, it can refer to the underwriting guidance to understand what factors to evaluate and consider during the review process.

Grant agreement template: This grant agreement template can be used between a Sponsoring Jurisdiction and a developer to formalize the award of grant funds for a housing project.

Project-specific ordinance template: This ordinance template can be used to formally establish a housing project as part of a Sponsoring Jurisdiction's MIRL Program, enabling the use of grant funds for an eligible housing project.

Developer report template: Developers must submit a report each year to the Sponsoring Jurisdiction for as long as the Grant Agreement is active. OHCS provides a reporting template that meets the basic requirements, but Sponsoring Jurisdictions can add their own requirements or use a different format if they prefer.
