Predetermination



Overview

In accordance with Senate Bill 1552 (effective 7/1/25), a petitioner may request a predetermination from the Board as to whether a criminal conviction will prevent the petitioner from receiving a psychologist license in Oregon.

Required Information

Petitions must include, but are not limited to, the following:

  • Personal information including name, address, phone number, and date of birth.
  • An attestation that the petitioner has read and understands OAR 858-010-0019.
  • Fully complete and accurate information about all previous criminal convictions, including:
    • Conviction Date
    • Criminal Conviction Description
    • Charging State & Agency
    • Severity (Felony, Misdemeanor, or Other Infraction)
  • Documents related to each criminal conviction:
    • Arrest Report(s)
    • Charging Documents(s)
    • Final Judgement of Conviction
    • Probation and Parole Records (if applicable)
    • Completion of Court-Ordered Terms & Conditions
    • Petitioner’s statement regarding the facts underlying the conviction and any intervening circumstances
  • Certifying statement as follows:
I hereby petition the Oregon Board of Psychology for a predetermination as to whether my criminal conviction(s) will prevent me from receiving a license issued by the Board.  I understand that the petition fee is nonrefundable, even if I do not receive a favorable determination.  If my petition is found to be incomplete, I am responsible for providing any required information.  If I fail to complete my petition within 60 days from the date I submitted it, then my petition will expire and I will need to submit a new petition with all supporting documentation and fee to receive a predetermination.
I certify that I have disclosed all criminal convictions and have not omitted or misrepresented any material fact regarding my conviction(s).  I understand that the predetermination I may receive as a result of this petition is not a final determination of the Board.  The Board will reconsider a predetermination if I later submit a licensure application, and may rescind any prior predetermination under certain circumstances including subsequent criminal conduct.  The Board may deny an application for reasons other than conviction of a crime.  
I understand that this petition is not an application for licensure, and my petition and any resulting Board predetermination does not in any way authorize me to provide mental health services in Oregon.
  • Payment of the $125 petition fee (non-refundable).
Petitions and the Board’s predeterminations are subject to Oregon’s Public Records Laws, and unless an exemption applies, the information is subject to public disclosure.

How to Submit a Petition

Petitions are submitted via the Applicant Portal.  Click "Apply Now' to create your account, and once logged in, click "Start Petition."  Use the same login credentials that you establish to later log in and check the status of your petition, or later after earning your qualifying degree, to submit a licensure application.  You can use the “forgot password” function if you do not remember your password, or if you are unsure which email address you have on record with the Board for your login, please contact us.

Once a petition is submitted, the petitioner will receive a confirmation email.  Board staff will review the submission and determine if any information or documents are missing.  If so, the petitioner will receive an email with "Petition is Incomplete" in the subject line with instructions for submitting additional required items.  All information must be received within 60 days of petition submission, or else the petition will expire.  Following a review of a complete petition, the petitioner will receive an email with "Petition Predetermination Result" in the subject line that indicates whether the Board determined that the petitioner's criminal conviction(s) as presented would or would not prevent the petitioner from receiving a license issued by the Board.  Because the Board meets only in even-numbered months (see calendar), the predetermination may take up to 2.5 months depending on timing of completion.
