| Overview |

The regulatory process by which stormwater impacts associated with Oregon Department of Transportation (ODOT) projects are addressed has often led to preventable project delays and increased costs. Stormwater is regulated by the Oregon Department of Environmental Quality (DEQ) under the Clean Water Act and by the National Marine Fisheries Service (NMFS) and the U.S. Fish and Wildlife Service (USFWS) pursuant to the Endangered Species Act (ESA). ODOT must work collaboratively with these agencies to manage the State’s transportation system in a cost-effective manner while protecting and improving Oregon’s water resources. A task force comprised of agency representatives from DEQ, NMFS, USFWS, the U.S. Environmental Protection Agency (EPA), and the Federal Highway Administration (FHWA) is developing a process to streamline the manner in which stormwater runoff is addressed that results in an overall environmental benefit and promotion of species recovery, which meets the regulatory needs of the natural resource agencies and provides ODOT with certainty regarding scope, schedule, and budget.
