Laws and rules
Regulations governing the Board of Body Art Practitioners in Oregon are contained in Oregon Revised Statutes (ORS) 690.350-690.415 and 690.992 and Oregon Administrative Rules (OAR) Chapter 331, Divisions 900-950.
 
Oregon Health Licensing Agency (OHLA) statutes and rules related to procedural, administrative, licensing and regulatory compliance requirements for all OHLA-regulated professions are found in ORS 676.600-676.625 and 676.992 and OAR 331, Divisions 001-030.

2011 Legislation Establishes New Body Art Board
To address public health and safety concerns about emerging body art practices, the Oregon Legislature in 2011 established the Board of Body Art Practitioners to advise the Oregon Health Licensing Agency (OHLA) on the regulation of body piercing, dermal implanting, electrology, scarification and tattooing.

Proposed Administrative Rules - Public Comment May 1 through May 29, 2012
The Oregon Health Licensing Agency (Agency) filed proposed administrative rules with the Secretary of State Office for publishing in the Oregon Bulletin on March 1, 2012.  Written public comment will be accepted from May 1 through May 29, 2012 at 5 pm.  Public comments can be sent to the following:

The Oregon Health Licensing Agency filed temporary administrative rules with the Secretary of State Office on March 1, 2012 for body piercing, earlobe piercing speciality body piercing and tattoo. Temporary administrative rules will expire on June 25, 2012.

Body Art Temporary Rules on Fees - Effective March 5, 2012
The Oregon Health Licensing Agency filed a temporary administrative rule with the Secretary of State Office on March 5, 2012. The temporary administrative rule waives body piercing practical and written exam fees, facility application and facility license fees for licenses issued prior to January 1, 2012 and practitioner renewal fees for licenses issued prior to January 1, 2012.

The temporary administrative rule will expire on September 1, 2012.

Temporary Rule for Tattoo Reciprocal Temporary License Suspended March 30, 2012
The Oregon Health Licensing Agency (Agency) filed temporary administrative rules with the Secretary of State Office on March 20, 2012 to allow individuals to obtain a temporary reciprocal tattoo license if they hold a current valid tattoo license issued by another regulatory authority which is not equivalent to Oregon’s tattoo licensure qualifications. After further review of the statutes and rules the Agency has determined it is unnecessary to have a temporary reciprocal tattoo license.  As of March 30, 3012 the Agency has suspended the temporary rule creating a temporary reciprocal tattoo license.

Temporary Rule for Temporary Tattoo License - May 3, 2012
The temporary amendment removes the requirement that applicants for a temporary tattoo license provide evidence of a high school diploma or General Educational Development (GED) certificate. Tattooists from outside of Oregon come to the state to work for short periods at tattoo conventions and professional events. Some tattooists are not able to obtain a copy of a diploma or GED certificate in time to participate in the convention or event. The safety of the public is not impacted by this modification because the requirements for experience in tattooing and blood-borne pathogen training is maintained.
