Introduction
In 2011 the Oregon Court of Appeals reversed and remanded the Land Conservation and Development Commission (LCDC) approval of the McMinnville Urban Growth Boundary (UGB) amendment in
1000 Friends of Oregon v. Land Conservation and Development Commission, 244 Or App 239 (2011). After LCDC remanded the decision to McMinnville, the city paused further consideration of a UGB amendment for several years. On December 11, 2020, McMinnville and Yamhill County submitted a revised decision responding to the LCDC remand order and amending the McMinnville UGB. The Department will receive any objections during the 21-day comment period, and then has 120 days to either approve the submittal, remand the submittal, or refer the submittal to the Land Conservation and Development Commission.

Director's Decision
The Director received one objection to the December 11, 2020 UGB submittal from McMinnville. In his decision, dated April 9, 2021, the Director rejected the objection and approved the city’s UGB submittal. The Director’s decision was not appealed to the Land Conservation and Development Commission within the 21-day appeal period, so McMinnville’s amended UGB is approved and acknowledged by the State of Oregon.
