Oregon Psilocybin Services – Administrative Rules

Background on the Rulemaking Process

Oregon Psilocybin Services (OPS) section is required to adopt administrative rules to administer ORS chapter 475A, the Oregon Psilocybin Services Act. The rulemaking process is informed by recommendations from the Oregon Psilocybin Advisory Board (OPAB), input from Rules Advisory Committees (RACs), and comments received during public comment periods. You can read current OPS administrative rules here: Oregon Administrative Rules 333-333. Oregon Psilocybin Services (OPS) expects to open administrative rules during the fall of each year. 

OPS licensees, license applicants, and training programs can refer to the OPS Guidance on Administrative Rules for guidance on how to comply with OPS administrative rules.

2025 Temporary Rule

Oregon Psilocybin Services (OPS) filed a temporary rule amending OAR 333-333-4300 related to psilocybin service centers. The temporary rule amends OAR 333-333-4300(6) to require that an authorized temporary use may only occur between the hours of 6:00 AM and 11:59 PM local time. This temporary rule is effective Friday, August 29, 2025.

OPS recently discovered an unintended loophole in administrative rules regulating hours of operation and authorized temporary uses for service centers. The temporary action will explicitly prohibit temporary uses at licensed service centers after 11:59 PM. Service centers are required to comply with this temporary rule.

2025 Temporary Rule - Public Comment Period

All members of the public are invited to provide comments on the proposed changes to 333-333-4300 during the public comment period, December 1, 2025 - December 21, 2025 (closing at 5:00pm Pacific Time). During the public comment period, you can e-mail your comments in writing to: publichealth.rules@odhsoha.oregon.govYou can also share your comments by participating in the virtual public hearing scheduled for Tuesday, September 16, 2025 (more information below). As a reminder, the proposed rules do not represent the final adopted rules.

2025 Temporary Rule - Public Hearing

OPS will host a virtual public hearing on December 16, Noon - 1pm (pacific time). Any member of the public can attend and participate in the public hearing. To sign-up to provide comments, please use the Virtual Sign-Up sheet in advance of the hearing.  In the time remaining, those who do not sign-up in advance will likely still have an opportunity to comment. 

Spanish and American Sign Language (ASL) interpretation and CART captioning will be provided.

On October 24, 2025, OPS adopted new and updated administrative rules.

These rules were informed by Rules Advisory Committees (RACs), public hearings, and written public comments received during the 2025 public comment period. Public hearings included Spanish interpretation, American Sign Language interpretation, and communication access real time translation (CART captioning) and recordings can be accessed below. OPS also sent and published a Letter to the Public highlighting frequent themes and how they have been addressed, in addition to letters sent to licensees, training programs, and permitted workers about the new and updated rules. These letters were sent and published on November 4, 2025:

2025 Regular Rulemaking - Public Hearings

OPS hosted two virtual public hearings on September 16 and September 18, 2025. Any member of the public could attend and participate in the public hearings. Spanish and American Sign Language (ASL) interpretation and CART captioning were provided. 2025 Regular Rulemaking - Rules Advisory Committees (RACs)

OPS convened 3 Rules Advisory Committee (RAC) meetings in July to discuss draft rules related to psilocybin services, including implmentation of 2025 legislation. Meeting materials and audio recordings are available by clicking the meeting dates below. 

RACs are an important part of the rulemaking process. RAC members provide input on draft administrative rules.  RACs are comprised of individuals who have subject matter expertise, lived experience, and who are likely to be affected by the proposed rules. The RAC process is designed to include a diversity of opinions and viewpoints. In addition to providing recommendations, RACs evaluate fiscal and racial impact of the proposed rules. Draft rules are updated based on RAC input, and the next version of proposed rules is then made available during the public comment period.

Oregon Psilocybin Services (OPS) follows the highest standards for administrative rulemaking, which includes robust public engagement to support transparency, accountability and trust.

In addition to receiving recommendations from the Oregon Psilocybin Advisory Board (OPAB) in accordance with ORS 475A, OPS offers annual public listening sessions to offer opportunities for members of the public to share feedback on the administration of ORS 475A. Public listening sessions are not part of the official rulemaking process, but they have been scheduled each year, offering opportunities to participate during day and evening hours. Spanish and American Sign Language (ASL) interpretation and CART captioning are provided during these three listening sessions.

After receiving OPAB recommendations and feedback from public listening sessions, OPS begins the rulemaking process by inviting members of the public to apply to serve on Rules Advisory Committees (RACs). The invitation is sent through the OPS Distribution List, published on the OPS website, and shared during regularly scheduled meetings.

OPS schedules multiple, separate RACs to discuss different sections of draft rules, the fiscal impact statement, and the equity impact statement. Multiple RACs offer more opportunities for diverse perspectives to be shared. OPS publishes the meeting dates and RAC meeting materials, including the first draft of rules that will be discussed, on the OPS Administrative Rules webpage prior to the RACs convening. This information is also sent to the OPS Distribution List.

After RACS conclude, OPS revises the draft rules and publishes the proposed rules on the OPS website in preparation for the 21-day public comment period. During the public comment period, which is advertised through the OPS Distribution List and published on the OPS website, OPS hosts multiple public hearings on the proposed rules. By offering multiple public hearings, OPS creates more opportunities for members of the public to participate at various times of the day, including day and evening hours. Spanish and American Sign Language (ASL) interpretation and CART captioning are provided during public hearings.
After the public comment period concludes, OPS considers feedback and finalizes administrative rules, submitting them to OHA leadership for approval and then to the Oregon Secretary of State in accordance with state agency processes for adoption.

Once rules are adopted, OPS writes a letter to the public to share information about decisions that were made. OPS also publishes a Hearings Officer Report that summarizes comments received.

Once final rules are adopted, OPS implements new rules and updates materials, processes, forms, and the TLC system.
