Oregon Medical Board Authority
Oregon law treats the practice of medicine as a privilege rather than a right, which allows the Oregon Medical Board to regulate who may practice and to intervene when a provider fails to meet professional standards, as provided in the Medical Practice Act (
ORS chapter 677). The Oregon Medical Board licenses and regulates physicians (medical doctors, osteopathic doctors, podiatrists), physician associates (PAs), and acupuncturists, more than 30,000 providers statewide, see
ORS 677.015.
Part of that responsibility is disciplining providers who violate the standard of care or engage in unprofessional conduct, up to and including suspending a provider's license. When evaluating a complaint, the Board asks whether a provider met the standard of care, the care an ordinarily careful provider would provide in the same or similar circumstances and whether their conduct violated medical ethics or endangered public health and safety.
What is a Board Action?A board action is any formal disciplinary step the Board takes against a licensed provider after investigating a complaint or concern. Depending on the severity of the conduct, this can include a reprimand, a period of probation, added conditions on a provider's license, a suspension, or revocation of the license entirely. What is an Emergency Suspension?On very rare occasions, evidence will show that a provider's continued practice poses an immediate danger to Oregonians. When that happens, the Board is required by law to take action to protect existing and future patients from harm by issuing an emergency suspension as provided in
ORS 677.205(3). The emergency suspension immediately stops a provider from practicing before the Board's usual investigation and hearing process has run its course. Because it cuts off a provider's ability to practice right away, Oregon law reserves it for that narrow circumstance rather than for routine violations
Once an emergency suspension is issued, the licensee is notified immediately, must stop practicing medicine, and provided 90 days to request a formal hearing to contest the suspension order. An emergency suspension stays in effect until a subsequent Board order terminates the suspension. Just like other Board actions, emergency suspensions are a matter of public record and are listed in the resources above.
