Amendment of 339-005-0000 Fees.  Establishes a $100 fee for the Pre-determination process of whether a past criminal conviction will prevent licensure (339-010-0058).  Notice filed on 12/3/2025.

Adoption of 339-010-0047 Servicemember, Spouse or Domestic Partner SCRA Practice Permit.  Implements 50 USC §4025a, which was amended in December 2024 relating to the Federal Servicemembers Relief Act (SCRA) and professional licensure portability. Notice filed on 12/3/2025.


Recently Amended Rules

Effective 8/20/2025:

Adoption of 339-010-0058 Criminal Conviction Determination Process.  Implementation of SB 1552 (2024) Section 44, which allows a person to petition a licensing board for a determination as to whether any criminal conviction would prevent the person from receiving a license.  No public comments were received.

Effective 5/30/2025:

Amendment of 339-010-0021 Impositions of Civil Penalties (3) and (3)(f):

The rule text in (3) is revised and in (3)(f), the rule text establishes the violation of $1000 per day an unlicensed individual is employed as an occupational therapy practitioner. No public comments were received.

Effective 7/22/2024:

Amendment of 339-010-0005 (6)(c)(L) under definitions in regards to feeding and eating:

339-010-0005   Definitions

(6)(c)(L) Management of feeding and eating to enable swallowing performance;

(6)(c)(L) Management of feeding, eating, and swallowing to enable eating and feeding performance.

(Per the 2022 AOTA Practice Act).  No public comments were received.

Effective 11/1/2023:

1) Amendment of 339-010-0040(9) & (10)  Limited Permit - Designates official abbreviations to be used by an OT of OTA when working under a limited permit.   No public comments were received.

2) Amendment of 339-010-0020(5)(i)  Unprofessional Conduct - applies to person claiming to be an occupational therapy practitioner when they do not hold a current license or limited permit.  No public comments were received.

3) Amendment of 339-020-0080(1) CE Certification - Updates the CE Certification rule to include the required OHA pain management course as stated in 339-020-0015(1).  No public comments were received.

September 2025 - Proposed amendment to 339-010-0045  Application for Temporary License by Military Spouse or Domestic Partner per the Servicemembers Civil Relief Act (SCRA).
