Item A: Draft Meeting Minutes (Action)
Commissioners will review and take action on proposed draft minutes from the September 2026 regular meeting.

Item B: Climate Protection Program Update (Informational)
DEQ will provide an update on the Climate Protection Program’s Emissions-Intensive Trade-Exposed (EITE) rulemaking and other program updates. The EITE rulemaking will determine how EITE industrial facilities, such as pulp/paper mills, steel mills, semiconductor manufacturers and concrete manufacturers, will be regulated by the program starting in 2028. The rulemaking aims to incentivize emissions reductions at these facilities, while recognizing the special circumstances they face by being exposed to competitive trade and the role they play in Oregon’s economy. DEQ plans to present proposed rules to the commission for action in mid-2027.

Item C: Internal Audit Overview (Informational)
DEQ will provide an overview of its Internal Audit (IA) function, re-established in March 2024 and led by the Chief Audit Executive. IA follows the Institute of Internal Audit (IIA) Global Internal Audit Standards for effectiveness and independence. This presentation will cover the IA functions mandate and independence structure, the risk-based 2026 IA plan, current audit highlights, and IA’s advisory role in agency accountability.

Item D: Fuel Tank Seismic Stability Certificates of Financial Responsibility Rulemaking (Informational)
DEQ will provide an overview of the Fuel Tank Seismic Stability (FTSS) Program. Senate Bill 1567 established the program in 2022. It requires owner/operators of bulk oils or liquid fuel terminals within Columbia, Multnomah and Lane Counties with storage capacity of two million gallons or more to conduct seismic vulnerability assessments, then develop and implement risk mitigation plans to remediate identified vulnerabilities. This presentation will include information about a proposed rulemaking that would amend the FTSS program to require owner/operators to maintain financial assurance mechanisms capable of covering spill-related liabilities up to a statutory maximum of $300 million. DEQ will present proposed rules to the commission for action in January 2027.

Item E: Recycling Modernization Act 3 Rulemaking (Informational)
DEQ will provide an informational update on the third rulemaking for the Recycling Modernization Act, in preparation for proposed permanent rules being presented to the commission for action in January 2027.

The commission will hold a working lunch and executive session, pursuant to ORS 192.660(2), (f) and (h). Per state law, members of the media are permitted to attend executive sessions; however, they may not report on the specifics or details of any discussions or information presented during these sessions. Item F: Total Maximum Daily Load Program Overview and Upcoming Watershed Rulemakings (Informational)
DEQ will provide an overview of its clean water plans for Oregon watersheds, called Total Maximum Daily Loads (TMDLs). This presentation will cover how DEQ develops TMDLs, both technically and through public engagement, and outline the 2027 timeline for TMDLs. TMDLs identify pollution sources and reduction efforts to improve water quality. In 2027, DEQ expects to bring items to the commission for several watersheds (Rogue, John Day, Snake River, Middle Columbia-Hood Miles Creeks, and Umpqua Basins), under court-ordered deadlines to address high water temperatures.

Item G: 25 Years of the Oregon Beach Monitoring Program (Informational)
DEQ will provide an overview of the Oregon Beach Monitoring Program (OBMP), including the program’s history, challenges and accomplishments over the last quarter century. OBMP helps protect public health by monitoring nearshore marine and beach freshwater for fecal bacteria. The program started in 2001 by DEQ, the Oregon Health Authority and the Oregon Parks and Recreation Department after the passage of the 2000 Beaches Environmental Assessment and Coastal Health Act.

The commission will provide an opportunity for public comment on any environmental and public health issues relevant to DEQ and EQC. Sign-ups to comment will occur shortly before the start of this agenda item, and people should limit comments to two minutes or less. The commission may reduce comment times at its discretion. The commission cannot accept comment on the following proposed rulemaking: Recycling Modernization Act 3.
