A Supplemental Environmental Project is an environmentally beneficial project or activity, that is not otherwise required by law, that an individual or entity that has been issued a civil penalty from DEQ (respondent) agrees to undertake as part of the settlement of an enforcement action. The criteria OCE considers when evaluating a proposed SEP is set forth in DEQ’s’ Internal Management Directive for SEPs. Pursuant to the IMD, OCE can mitigate a civil penalty up to 80% if a respondent invests at least that amount into an approved SEP.
