Abortion is legal in Oregon even after the Supreme Court overturned Roe v. Wade in 2022.

OHA Statement on U.S. Supreme Court’s Mifepristone Ruling

Oregon Health Authority is aware that on May 1, a federal appeals court issued a ruling that temporarily stopped abortion providers’ ability to use telemedicine to prescribe the abortion medication mifepristone and send the pills to patients by mail. On May 4, the U.S. Supreme Court temporarily paused the Fifth Circuit Court’s ruling and restored access to mifepristone. On May 14, the U.S. Supreme Court blocked the Fifth Circuit Court’s ruling, allowing continued access to mifepristone by mail and telehealth. The case will now return to the Fifth Circuit Court to decide on the merits of the case. OHA is continuing to review these recent court decisions in consultation with the Oregon Department of Justice and the office of Gov. Tina Kotek.
 
Mifepristone was first approved by the FDA more than 20 years ago and is a safe and effective method of ending an early pregnancy. In 2024, medication abortion accounted for nearly 63% of abortions performed in Oregon, according to OHA data.
