Overview
DUII Services Providers provide the following services as outlined in
Oregon Administrative Rule (OAR) 309-019-0195:
- Assessment – DSPs conduct substance use disorder diagnostic evaluations and determine the appropriate level of care for individuals including: service type(s), frequency and duration.
- DUII Program Administration – DSPs provide DUII Education. For individuals with a substance use disorder, DSPs also provide DUII Rehabilitation (substance use disorder treatment) services. DSPs reports to the ADSS, DMV, and the Division about the individual's progress and program completion status.
Assessment
Complete assessments at time of entry as outlined in
OAR 309-019-0135. This includes:
- A Level of Care Determination consistent with The ASAM Criteria.
- Confirming the presence or absence of an SUD diagnosis as defined in the Diagnostic and Statistical Manual of Mental Disorders (DSM–5).
- Documentation that supports the ASAM Level of Care and diagnosis determinations.
This assessment determines whether the individual must complete DUII Education and/or DUII Rehabilitation under OAR 309-019-0195(4) and (7).
DUII Program Requirements
DUII Education only programs shall include a minimum of four sessions over a four-week period and include the provision of a minimum of 12 hours of didactic education. The minimum 12 hours does not include diagnostic assessment, service
planning, or transfer planning. No more than four of the 12 minimum hours shall be conducted utilizing educational films or pre-recorded audio-visual presentations.
DUII Education topics shall include, but are not limited to:
- Completion of a Division approved DUII Education Pre-Post Test;
- DUII Laws and Consequences in Oregon;
- Use of alcohol and other drugs, and their effects on driving;
- Physical and psychological effects of alcohol and other drugs of abuse;
- SUD signs and symptoms;
- SUD recovery support services; and
- Alternatives to intoxicated driving.
In addition to completing DUII Education, DUII Rehabilitation shall include
completion of the SUD treatment services outlined in the individual’s service plan
as outlined in OAR 309-019-0140.
During DUII Education or DUII Rehabilitation, individuals are expected to abstain from use of intoxicants. Individuals must abstain at all times in the final 90 days of the DUII Rehabilitation program.
Individuals in DUII Education who provide a positive urinalysis test or who self-report use of a substance must complete DUII Rehabilitation.
As a Schedule 1 drug, medical marijuana does not meet the exceptions allowed in ORS 813.200 for a valid prescription or nonprescription medication.
OHA strongly encourages DSPs to develop policies and procedures consistent with the ASAM Consensus Statement on the Appropriate Use of Drug Testing in Clinical Addiction Medicine.
Conduct urinalysis tests as often as deemed clinically appropriate, but no less than:
- At the time of assessment; and
- Twice per calendar month with no more than 14 calendar days between tests; and
- Within two weeks prior to completion; and
- Within 72 hours of receipt of laboratory results indicating that a urinalysis sample is out of range for Creatinine, pH, or Specific Gravity.
At a minimum, samples must be tested for the following substances:
- Alcohol;
- Marijuana;
- Cocaine;
- Amphetamines;
- Opiates; and
- Benzodiazepines.
At a minimum, also conduct an EtG/EtS test for alcohol:
- At the time of assessment and
- Within two weeks of program completion.
As allowed by HIPAA and 42 CFR Part 2, issue documentation when an individual:
- Successfully completes a DUII program or
- Does not complete the DUII program, and
- Complies with the terms of their fee agreement between the provider.
If an ADSS referred the individual, also send documentation to the ADSS.
For individuals convicted of a DUII in Oregon, also issue a numbered DUII Treatment Completion Certificate (DTCC) if they have successfully completed the program.
- The DTCC is a carbonless form that produces an original and three copies. Send the original DTCC to the Oregon DMV per the directions on the DTCC.
- Provide one copy to the individual and another copy to the ADSS.
- Keep a copy in the individual’s service record.
Division-approved DSPs can order DTCCs by emailing DUII.Info@oha.oregon.gov.
Send report to OHA through ROADS.
Also report to the referring ADSS as allowed by HIPAA and 42 CFR Part 2:
- No later than 30 calendar days from the date of referral;
- Every 30 calendar days while enrolled in DUII Rehabilitation;
- No later than 14 calendar days from the date of discharge;
- No later than seven calendar days from the written request of the ADSS.
