Rulemaking Process Overview

Before starting the rulemaking process, Oregon Health Authority (OHA) holds meetings to discuss proposed rule changes. Meeting dates, locations and times are on the OHA meetings calendar. After that, OHA takes these steps:

  • Publishes a rulemaking notice. The notice summarizes the rule changes, invites interested parties to provide comment at a public hearing or in writing.
  • Accepts, reviews and incorporates public comment. This feedback may change the proposed rule.
  • Files the final rule changes with Oregon Secretary of State. Changes may be to adopt, revise or repeal rule(s). 

Current Oregon Administrative Rules

Please refer to the Oregon Secretary of State (SOS) website for current rules on file. Click the program name, then click the rule you want to view. The current rule will display. 

  • To view previous revisions of the rule, click the revision date(s) at the bottom of the rule page. Revisions are available back to 2017. If you need older revisions, please email Adminrules.Archives@oregon.gov
  • If you have problems accessing older revisions not available on the SOS website, please email Medicaid.Rules@oha.oregon.gov

Active Oregon Health Plan Rulemaking

Oregon Health Plan rules are in Chapter 410. These are also known as Medicaid rules or Medical Assistance Program rules. To learn how to get involved in providing feedback before the rulemaking process begins, visit the Rules Advisory Committtees and Community Engagement page.

Notices of Proposed Rulemaking

This list shows all rule revisions OHA has proposed for permanent rule filing that are now open for public comment. For proposed rules:

  • Refer to the filing document how to participate in public hearings by computer, mobile device or phone.
  • Email written comment to Medicaid.Rules@oha.oregon.gov.

OHA will post all comments received on this page for public transparency. 

Each Notice of Proposed Rulemaking includes:

  • Statement of Need
  • How the rules will affect racial equity in Oregon
  • Fiscal and economic impact
  • The proposed rule
  • Hearing details

Permanent Rules

This list shows all recent permanent rule revisions filed by OHA, with a summary of any comment received following the Notice of Proposed Rulemaking.

Temporary Rules

Temporary rules are also known as emergency rules. These rules expire 180 days after the filing date. For each temporary rule filing, OHA intends to start the permanent rulemaking process to engage community and accept comment on the rule changes. 

The temporary rule filing includes:

  • The rule caption, rulemaking action and rule summary
  • The statement of need 
  • Justification for filing as a temporary rule
  • The adopted rule(s)
