Notice of Proposed Permanent Rulemaking:
OAR 333-090-0110, Healthy Homes Grant Program – “Acceptance of federally negotiated indirect cost rates from Federally Recognized Indian Tribes in Oregon”
The Oregon Health Authority (OHA), Public Health Division, Center for Health Protection, Environmental Public Health Section is proposing to permanently amend OAR 333-090-0110 pertaining to the Healthy Homes Grant Program (HHGP).
The nine Federally Recognized Indian Tribes in Oregon each have independently negotiated indirect cost rate agreements (NICRAs) in place with the federal government. These NICRAs stipulate indirect reimbursement rates higher than would be allowed under HHGP by current administrative rule.
Given the government-to-government relationship between the State of Oregon and the nine Federally Recognized Indian Tribes in Oregon, Tribes have an expectation that federal NICRAs be honored when dealing with the State of Oregon. Existing HHGP administrative rules prevent this from being allowed under the program.
This narrowly tailored administrative rule change will allow HHGP to honor Tribal NICRAs.
