Forensic Evaluation Complaint Process

Types of Accepted Complaints

Oregon Health Authority (OHA) will only accept complaints about the written forensic evaluation. If OHA receives a complaint about an evaluator, the Forensic Evaluation Review Panel will review the complaint. 

In either case, OHA and the panel's determinations will focus on whether the written forensic evaluation represents a substantial departure from the standards of practice established in Oregon Administrative Rule 309-090-0025.

Complaint Resolution

If the complaint warrants denying or revoking the evaluator's certification, OHA will provide written notice of its intent, which may include recommended steps for remediation.

  • The evaluator shall have 30 days to submit a written remediation plan and will have temporary certification status for up to six months until OHA determines whether the issues have been adequately addressed.
  • Issues that have been adequately addressed will result in the OHA withdrawing its notice and full certification restored.
  • If issues are not adequately addressed, OHA may proceed with denial or revocation of certification.
