Rulemaking Activity

Center for Health Statistics Rulemaking Activity


An Oregon Revised Statute (ORS) is a law passed by the Oregon State Legislature. An Oregon Administrative Rule (OAR) is a specific regulation created by a state agency to interpret, implement, or enforce the statute. Rules are developed by agencies through a rulemaking process that engages the public.
Information relating to rulemaking actions by the Center for Health Statistics - Vital Records section can be accessed in the accordions below for information on current Rule Advisory Committees (RACs) in progress. RACs are an important process that allow members of the public and communities to provide input and suggestions during the development of new rules or amending current rules.



Steps in the rulemaking process

  1. Notice of Proposed Rulemaking: OHA publishes a notice that explains the proposed rule and asks for public comments.
  2. Rule Advisory Committee (RAC): Invited members of the public and community partners provide input during the rule development process. 
  3. Comment Period: The public has a set amount of time to submit written comments.
  4. Consideration: OHA considers all comments and may decide to change the proposed rule based on the feedback.
  5. Final Adoption: The agency adopts the final rule.

Active Rule Advisory Committees

The RAC will provide feedback on draft Oregon Administrative Rules (OAR) that implement the vital records portions of Senate Bill 163 that go into effect on January 1, 2027.


New rules will include:​

  • Intent to marry (333-011-0262)

  • Witnessed Acknowledgments of Parentage (333-011-0266)

  • Notarized Acknowledgments of Parentage (333-011-0267)

  • Denials of parentage (333-011-0268)

  • Rescission of parentage (333-011-0269)

  • Gestational Surrogacy Agreements (333-011-0276)

l OAR 333-011-0270 Voluntary Acknowledgment of Paternity.​


The RAC will review proposed​ rule language and identify additional changes needed. RAC meetings conclude​​ in July, 2026 and permanent rules will be filed in December 2026.

Center for Health Statistics Rule​ Advisory Committee Community Participation ​


The Center for Health Statistics (CHS) section is seeking persons and communities who would be affected by administrative rules relating to any of CHS regulatory functions and who would be interested in serving on a rulemaking advisory committee (RAC).

RACs are an important process that allow members of the public and communities to provide input and suggestions during the development of new administrative rules, amending or repealing existing rules, and identifying the potential fiscal impact on small business as well as the effect on racial equity in Oregon. Diverse opinions and viewpoints are an important part of the rulemaking process.

Persons interested in serving on future RACs relating to any of these rules are encouraged to email Center for Health Statistics​​. Emailed requests will be saved and applicants contacted when future RACs are convened.
