Center for Health Statistics Rulemaking Activity

An Oregon Revised Statute (ORS) is a law passed by the Oregon State Legislature. An Oregon Administrative Rule (OAR) is a specific regulation created by a state agency to interpret, implement, or enforce the statute. Rules are developed by agencies through a rulemaking process that engages the public.
Information relating to rulemaking actions by the Center for Health Statistics - Vital Records section can be accessed in the accordions below for information on current Rule Advisory Committees (RACs) in progress. RACs are an important process that allow members of the public and communities to provide input and suggestions during the development of new rules or amending current rules.



Steps in the rulemaking process

  1. Notice of Proposed Rulemaking: OHA publishes a notice that explains the proposed rule and asks for public comments.
  2. Rule Advisory Committee (RAC): Invited members of the public and community partners provide input during the rule development process. 
  3. Comment Period: The public has a set amount of time to submit written comments.
  4. Consideration: OHA considers all comments and may decide to change the proposed rule based on the feedback.
  5. Final Adoption: The agency adopts the final rule.

The RAC will provide feedback on proposed ​drafts Oregon Administrative Rules (OAR) that implement the vital records portions of Senate Bill 163 from the 2025 Legislative Session​ that go into effect on January 1, 2027.

Notice of proposed permanent rulemaking – OAR chapter 333, division 11 – “Implementation of SB 163 (2025), identifying processes and requirements for establishing parentage of a child"​


The Oregon Health Authority, Public Health Division, Center for Health Statistics is proposing permanent changes to Oregon Administrative Rules in chapter 333, division 11 relating to the processes and requirements for establishing parentage of a child.


The purpose of this rulemaking is to adopt new rules required by passage of Senate Bill 163 (OL 2025, ch. 592) during the 2025 Oregon Legislative Session. Portions of Senate Bill 163 have an implementation date of January 1, 2027 and are addressed by this rulemaking.


Senate Bill 163 modifies how parentage of a child is established in Oregon. Senate Bill 163 requires the Oregon Health Authority (OHA), Public Health Division, Center for Health Statistics to adopt rules to (1) establish standards for preparing reports of live birth for the new methods for establishing parentage; (2) add parents to reports of live births who are not married but intend to; (3) establish parentage with a witnessed voluntary acknowledgment of parentage; (4) establish parentage with a notarized voluntary acknowledgment of parentage; (5) establish a denial of parentage process; (6) establish a process for rescission of acknowledgment or denial of parentage; and (7) establish a process to register the birth of a child under a gestational surrogacy agreement. 


​The rulemaking will also repeal the previous rule that established the processes of acknowledgment of parentage as a new rule is replacing it and will amend the rule on preparation of new birth records after amendment.

Center for Health Statistics Rule​ Advisory Committee Community Participation ​


The Center for Health Statistics (CHS) section is seeking persons and communities who would be affected by administrative rules relating to any CHS regulatory functions and who are interested in serving on a rulemaking advisory committee (RAC).​


RACs are an important process that allow members of the public and communities to provide input and suggestions when the development of new administrative rules, amending current rules or repealing existing rules, and identifying the potential fiscal impact on small business as well as the effect on racial equity in Oregon. Diverse opinions and viewpoints are an important part of the rulemaking process.
