Cannabis Laws in Oregon

Legal Use

  • Adults age 21 and older can possess and use cannabis within specified limits. 
    • The Personal possession limits for a person over age 21 are: 
      • Two ounces of usable marijuana in a public place;
      • Eight ounces of usable marijuana in your home;
      • 16 ounces of cannabinoid products in solid form or cannabinoid concentrates;
      • 72 ounces of cannabinoid products in liquid form;
      • One ounce of cannabinoid extracts purchased from a marijuana retailer; and
      • Four marijuana plants.

  • Public use and driving while impaired remain illegal. 
    • Driving under the influence of intoxicants (DUII) refers to operating a motor vehicle while intoxicate, including impairment from the use of marijuana.
  • The Oregon Medical Marijuana Act allows medical use of cannabis for qualifying medical conditions

Cities and Counties Prohibiting Cannabis Dispensaries or Processors

Cities or counties may adopt an ordinance prohibiting the establishment of a medical marijuana dispensary or medical marijuana processing site; and/or may prohibit the establishment of cannabis producers, processors, wholesalers and/or retailers within its jurisdiction.


Oregon's Indoor Clean Air Act (ICAA)

The ICAA prohibits smoking in the workplace and within 10 feet of all entrances, exits and windows or air vents. The ICAA includes the use of "inhalant delivery systems" including vape pens and e-cigarettes that can be used to deliver cannabinoids, nicotine and other substances.
