Program overview
The Climate Protection Program was recently invalidated by the Oregon Court of Appeals. In December 2023, the Court determined that DEQ did not fully comply with notice requirements during the 2021 Climate Protection Program rulemaking process, thereby invalidating the program. The Climate Protection Program was designed to dramatically reduce greenhouse gas emissions in Oregon over the next thirty years. The Climate Protection Program sets a declining limit, or cap, on greenhouse gas emissions from fossil fuels used throughout Oregon, including diesel, gasoline, natural gas and propane, used in transportation, residential, commercial and industrial settings. The program also regulated site-specific greenhouse gas emissions at manufacturing facilities, such as emissions from industrial processes, with a best available emissions reductions approach.
The Climate Protection Program aimed to:
- Reduce greenhouse gas emissions to address the worsening effects of climate change
- Achieve co-benefits from reductions in other air contaminants
- Enhance public welfare for Oregon communities, particularly environmental justice communities including communities of color, tribal communities, communities experiencing lower incomes, rural communities and coastal communities
- Accelerate the transition from fossil fuels to lower carbon energy sources
