Fuel Tank Seismic Stability 2027

The Oregon Department of Environmental Quality is conducting this rulemaking to implement requirements for large bulk fuel or oil terminals. House Bill 4100 (2026) requires these terminals to be able to cover spill-related liabilities, including spill response, remediation and damages up to $300 million. DEQ must develop rules that comply with federal standards, where appropriate, and align with the State of Washington's financial responsibility requirements. Statute establishes a deadline of March 31, 2027, for bulk fuel terminals to submit an application to DEQ for a certificate of responsibility. To account for the 28-day rule adoption period established in HB 4021 (2026) and to allow adequate time for application submittals, the agency aims to adopt the rule in early 2027.
