Fuel Tank Seismic Stability 2027

Proposed rule

The Oregon Department of Environmental Quality is conducting this rulemaking to implement requirements for large bulk fuel or oil terminals. House Bill 4100 (2026) requires these terminals to be able to cover spill-related liabilities, including spill response, remediation and damages up to $300 million. DEQ must develop rules that comply with federal standards, where appropriate, and align with the State of Washington's financial responsibility requirements. Statute establishes a deadline of March 31, 2027, for bulk fuel terminals to submit an application to DEQ for a certificate of responsibility. To account for the 28-day rule adoption period established in HB 4021 (2026) and to allow adequate time for application submittals, the agency aims to adopt the rule in early 2027. 

DEQ is convening an advisory committee to review the technical issues and fiscal impacts related to the proposed rules. In convening this committee, DEQ has appointed members that reflect the range of entities that are both directly and indirectly affected by proposed changes to the rules.

House Bill 4100 requires DEQ to compose an advisory committee of at least equal parts community, industry and local government representatives. DEQ also invited Tribal government representatives and personnel from other state agencies to participate. ​

Public involvement

DEQ will accept verbal public comments at the end of the second Rulemaking Advisory Committee meeting on Oct. 9, 2026, from 11:30 – 11:50 a.m.

DEQ will also hold a public comment period on the draft rules from late October to late November. This is tentatively planned for Oct. 30 – Nov. 30, 2026, which will include a public hearing on Nov. 18, 2026.
