The Environmental Quality Commission adopted rule amendments to allow TMDLs to be adopted by rule, in addition to issue by order, consistent to what is currently in ORS 468B.110. This proposed rulemaking will also include minor changes to update the rule language.

Advisory committee

DEQ convened an advisory committee to review the fiscal impacts related to the proposed rules. In convening this committee, DEQ appointed members that reflected the range of entities that are both directly and indirectly affected by proposed changes to the rules.

Public involvement

The comment period for this rulemaking closed at 4 p.m. on Nov. 12, 2021.

DEQ provided a brief presentation about the proposed changes to the EQC on July 22, 2021.

The Environmental Quality Commission adopted these rules at its meeting on Feb. 3, 2022.
