This rulemaking is to update water quality permit fees for Chapter 340 of the Oregon Administrative Rules divisions 045 and 071. The proposed rule amendments are to increase water quality fees by three percent or less in 2023 for fiscal year 2024, as provided in ORS 468B.051. These fees apply to National Pollutant Discharge Elimination System permits and Water Pollution Control Facility permits.


DEQ is convening an advisory committee to review the technical issues and fiscal impacts related to the proposed rules. In convening this committee, DEQ has appointed members that reflect the range of entities that are both directly and indirectly affected by proposed changes to the rules.

The comment period closed on July 21, 2023 at 4 p.m.

EQC action

Delegation
At the 426th Oregon Environmental Quality Commission meeting on May 19, 2023, the Environmental Quality Commission authorized delegation to Director Leah Feldon for the 2023 Water Quality Fee rulemaking. Director Feldon approved adopting these rules on Sept. 5, 2023.
