Dairy Air Emissions Petition

Dairy Air Emissions rulemaking petition

Petition contact: Heather Kuoppamaki, 503-407-7596

The Oregon Environmental Quality Commission received a petition for rulemaking from Food & Water Watch and 21 co-petitioners to adopt Dairy Air Emissions rules included in the petition.

The proposed rules included in the petition would establish a dairy air emissions program to quantify and regulate air emissions from large dairy confined animal feeding operations. DEQ does not currently regulate air emissions from most agricultural sources, which include dairy CAFOs. DEQ does permit the construction and operation of manure digesters producing biogas, some of which are part of agricultural operations.

The EQC is scheduled to act on the petition at a special meeting before Nov. 15, 2022. On behalf of the EQC, DEQ is requesting comment on whether to deny the petition, grant the petition and initiate rulemaking proceedings, or pursue another action.

If the EQC directs DEQ to begin rulemaking, DEQ will proceed with a process that will include a second opportunity for public comment.

Public involvement

The comment period closed at 4 p.m. on Oct. 23, 2022.

Comments received during the public comment period have been compiled into the following document.
