Toxic-Free Cosmetics Rules and Implementation

Effective January 1, 2027, Oregon's Toxic-Free Cosmetics Act (SB 546) prohibits the sale in Oregon by manufacturers and distributors of cosmetic products containing chemicals identified in the law.

SB 546 also directs the Oregon Health Authority (OHA) to develop a list of high-priority chemicals of concern used in cosmetic products (HPCs). Manufacturers of cosmetic products containing one or more HPCs on this list will be required to include a notice for Oregon consumers on the manufacturer’s website informing them of potential health effects associated with the chemical(s). This will allow consumers to be better informed about the cosmetic products they purchase.

The Toxic-Free Cosmetics Act, codified in Oregon Revised Statute (ORS) 431A.335 - 349, directs OHA to develop Oregon Administrative Rules (OARs) that establish compliance requirements.

Drafted with the assistance of a Rules Advisory Committee (RAC), OHA proposed OARs for public comment in November 2026.

Rules and Rulemaking

OHA organized a Rule Advisory Committee (RAC) consisting of industry representatives, public health and environmental advocates, and governmental organizations to help develop rule language. The RAC provided input for the 1st Rulemaking for TFC Act.

1st Rulemaking for TFC Act (July to October 2026)	Details requirements for the prohibition of certain chemicals in cosmetic products manufactured or distributed in Oregon. Specifies high priority chemicals used in cosmetic products (HPCs); Details how and when HPCs are to be selected in the future; Establishes requirements for manufacturers of cosmetic products with HPCs sold or distributed in Oregon to provide notice.
