Section 811 PRA Occupancy Standards and Exceptions

Guidance for Property Owners and Managers

The Section 811 Project Rental Assistance (PRA) program follows HUD’s Handbook 4350.3 for occupancy requirements, with specific exceptions outlined by HUD Notice H 2013-24. This ensures that the program remains flexible and responsive to the needs of individuals with disabilities.

Key Occupancy Guidelines

  • Primary Reference: HUD Handbook 4350.3 – Occupancy Requirements of Subsidized Multifamily Housing Programs 
  • Exceptions Apply: Certain paragraphs of the handbook do not apply to the 811 PRA program. These are detailed below.

Not Applicable Handbook Sections

Chapter 3 – Eligibility

  • 3-7: Income limit exceptions for Section 8 do not apply 
  • 3-8: Over-income applicants are not admitted 
  • 3-12: Restrictions on assistance to noncitizens are modified 
  • 3-18 to 3-20: Elderly project eligibility rules do not apply to PRA

Chapters 2 & 4 – Marketing

  • Affirmative marketing requirements are replaced by HUD Notice H 2013-24, Section IV.B

Chapter 5 – Rent Calculations

  • 5-28: Double occupancy in group homes – not applicable 5-29: BMIR rent calculations – not applicable

Chapter 8 – Termination

  • 8-7: Termination based on citizenship/immigration status is modified

Chapter 9 – Income Verification
