We are writing to let you know of an important update about your apartment at [INSERT PROJECT NAME]. As of [INSERT DATE], the affordability period will expire and the property owner will no longer be legally required to maintain current affordable rent levels or income requirements. After that, the [PROJECT NAME] enters a three-year “Safe Harbor” period.
What does this mean for you?
For the next three years, during the Safe Harbor period, tenants are protected from nocause evictions and rent increases are subject to Oregon Housing and Community Services (OHCS) policy. We understand that potential changes to your rent can be stressful, and we want you to know your rights:
- Your landlord
cannot evict you without cause (without a valid reason).
- Your rent
can only go up once per year.
- Note: If you have a Housing Choice Voucher, also known as Section 8, the amount of rent you are responsible for paying each month is based on your adjusted monthly income. Adjusted monthly income is determined by your local housing authority.
- Any rent increases must comply with the rent increase policy of OHCS and state law (ORS Chapter 90). The Oregon Department of Administrative Services (DAS) publishes the maximum rent increases allowed by law each year.
