The Oregon Environmental Quality Commission met on May 19 and 20. Commissioners and some DEQ staff met in-person at the Portland DEQ office; however, access for the public was via Zoom, an online video conferencing platform, with toll-free telephone access for audio-only connections.

Welcome and meeting open
The commission will convene the public meeting and review the day's agenda.

Item A: Oregon Clean Vehicle Rebate Program rules (Action)
DEQ will propose updated permanent rules for the Oregon Clean Vehicle Rebate Program. The proposed rules reflect programmatic updates since the commission approved temporary program rules in November 2021, and direction from the 2021 and 2022 Oregon Legislatures.

Item B: Oregon Clean Fuels Program updates (Informational)
DEQ will present informational updates about the Oregon Clean Fuels Program, in preparation for proposed rule updates in fall 2022.

Item C: Asbestos Program Fee rules (Action)
DEQ will propose fee increases, as authorized by the 2021 Oregon Legislature, to stabilize revenue for the Asbestos Program.

Item D: TMDLs by rule, 2022-2024 (Discussion/concurrence)
DEQ will discuss and propose a list for commission concurrence to approve which TMDLs, or watershed management plans, will be adopted by EQC vote between 2022 and 2024.

Item E: Water quality memorandum of agreement between DEQ and Oregon Department of Agriculture (Informational)
DEQ and ODA will co-present updates on the MOA between the two agencies for the protection of water quality across the state related to agricultural operations.

Item F: Public forum
The commission will open an opportunity for general public comment on environmental and public health issues of interest to EQC and DEQ.
  • Sign-ups to present comment will occur at the start of this item
  • People are asked to limit all comment to three minutes or less
    • This time limit may be reduced if the number of people requesting to present comment would exceed the allotted item time 
    • The commission will affirm commenters' time once sign-ups have occurred at the meeting

The commission will recess the public meeting until 9:15 a.m. on Friday, May 20.

The commission will have an executive session, held pursuant to ORS 192.660(2)(f) and (h). Executive session is a closed meeting for commissioners, specific DEQ staff and staff from the Oregon Department of Justice, to discuss confidential legal information and updates. Per state law, members of the media may attend executive session; however, they may not report on the specifics or details of any discussions or information presented during executive session.

Commissioners will review and act on the proposed draft minutes from recent commission meetings.

Commissioners will provide verbal updates on their activities and work of interest to the commission and DEQ.

DEQ will present information about updates to the state’s aquatic life use rules, in preparation for proposed rule updates in fall 2022.

Item J: 2022 Water Quality Integrated Report (Informational)
DEQ will present information about the agency’s 2022 Water Quality Integrated Report.

Item K: Recognition of DEQ's Ambassadors of Public Service (Informational)
The commissioners and DEQ will recognize the employees nominated for the 2022 Ambassadors of Public Service awards, presented annually by the Governor's Office.

Director Whitman will present written and verbal updates on agency activities and other issues of interest to the commission.
