The commission met by teleconference. People could attend the regular meeting through the Zoom web conferencing platform, for audio and video, or by audio-only toll-free telephone line.

Meeting open and welcome
The commission will convene the 413th regular meeting of the Oregon Environmental Quality Commission.

Item A: Draft meeting minutes (Action)
The commission will review and take action on the draft minutes from the Jan. 21-22, 2021, regular and March 3, 2021, special EQC meetings.

Item C: 1200Z Industrial Stormwater Permit rulemaking (Action)
DEQ will present the proposed 1200Z industrial stormwater general permit for commission consideration and action.

Commissioners will provide verbal updates of their recent activities of interest to the commission and DEQ.

Item D: Cleaner Air Oregon Program update (Informational)
DEQ will present an update on the work of the Cleaner Air Oregon Program over the past two years.

The commission will open a comment opportunity specific to the discussion and materials regarding the Cleaner Air Oregon Program update. People are asked to limit their comments to two minutes or less; however, the commission may modify times as needed to accommodate all speakers.

Item E: Oregon Environmental Protection Act reports (Informational)
The commission will respond to three reports submitted by DEQ as part of the Oregon Environmental Protection Act. These reports address recent federal changes that could result in less stringent standards under the Clean Air Act and Clean Water Act.

Item F: Public forum
The commission will open a general comment opportunity for comment. During this time, any person may address the commission on environmental and human health issues of concern. People are asked to limit their comments to three minutes or less; however, the commission may modify times as needed to accommodate all speakers.

  • The commission and DEQ staff are not prepared to engage in discussion or answer questions during this item
  • The commission may not receive comments on any DEQ rulemaking matter for which a comment period has been held and closed.

Item H: Clean Fuels Program Electricity rulemaking (Action)
DEQ will propose rules to advance methods accelerating the generation and aggregation of clean fuels credits for electricity in order to advance the state's transportation electrification goals.

Item I: Greenhouse Gas Programs update (Informational)
DEQ will present an update on Greenhouse Gas Programs, including the development of the Climate Protection Program and rules, the Statewide Transportation Strategy and general outreach/engagement opportunities.

Director Whitman will present written and verbal updates on agency activities and other issues of interest to the commission.

Item K: Budget and legislative updates (Informational)
DEQ will present an update on agency budget and legislative matters, and general updates about the 2021 Legislative Session.

Adjourn: The commission will adjourn the regular meeting

12:45 p.m.
Executive Session
At 12:45 p.m., the commission will convene an executive session. This executive session will be held pursuant to ORS 192.660(2)(f) and (h), for the commission to consider information or records that are exempt by law from public inspection and consult with counsel concerning the legal rights and duties of a public body with regard to current litigation or litigation likely to be filed.

Executive session is a closed meeting for only commissioners, specific DEQ staff and staff from the Oregon Department of Justice, to discuss confidential legal information and updates. Per state law, members of the media may attend executive session; however, they may not report on the specifics or details of any discussions or information presented during executive session.
