Community-Based Structured Housing (CBSH)

Requirements in Oregon Administrative Rules (OARs)

Application or Waiver for Registration

The following facilities are not required to submit a CBSH application. The division requires these facilities to submit a Waiver of Registration Form. 

  • Multifamily rental housing developments of five or more units that receive government rent assistance from the U.S. Department of Housing and Urban Development, or U.S. Department of Agriculture, or  any government assistance or subsidy identified in rules adopted by Oregon Housing and Community Services.
  • Any facilities already licensed or registered under any other Oregon law, or any Oregon city or county ordinance or regulation.

Application Process

Please complete the application or waiver request in full. 

For the application, this includes:

  • All required attachments.
  • Name, title, date and signature) completed in the Attestation of Compliance. This must be someone with legal authority to attest on behalf of the facility.
  • The $20 application fee. This is required under Oregon Revised Statute 443.425(3)(a) and (c).​

The division will not process incomplete forms. Incomplete applications and waiver requests are void 60 days after receipt.

​You must attach copies of the following documents with the completed application:

  • Description of program services
  • Proposed annual budget identifying sources of revenue and expenses
  • All policies and procedures
  • Position descriptions and qualifications for:
    • Applicant
    • Facility manager
    • Program staff
  • ​Evidence that all staff have successfully completed required trainings
  • Approved background checks for all staff
  • Employee code of conduct
  • Complete floor plan and building permits for any physical changes to the facility
  • Current approved/cleared fire inspection report
  • Current certificate of safe water supply, if available
  • Residency agreement

Submit the application, fee and required documents online at https://or.accessgov.com/dhshoha. (click "OHA Mental Health Residential Licensing," then choose "Community-Based Structured Housing").

If you cannot apply online:

  • Email the application and documents to BHD.MH.Applications@oha.oregon.gov
  • Mail the application fee to: BHD Licensing and Certification, 500 Summer St NE E86, ​Salem OR 97301

Upon receiving a complete application, the division will review all submitted material. Based on this review, the division may:

  • Respond with questions, 
  • Request more information, or 
  • Ask you to submit a new application. 

If additional information is needed, the division ​will ask you to provide the requested information with 14 days of the request.​  The division may also schedule an onsite review of the facility.

Within 30 days of completing the application review, the division will send a final report. You must submit a written Plan of Correction to the division within 30 days of receiving the report. The plan must show how you have resolved all issues listed in the final report.

Upon approval of your Plan of Correction, the division will verify the corrections you made are complete. If this corrections are complete, the division will issue a Letter of Registration. This letter will be effective for not more than one year.

To renew your registration, you must complete a new application at least 60 days before your current registration expires. If the division does not receive a complete application for renewal, your facility will be considered unregistered after the expiration date. Your facility may be subject to civil penalties if it continues to operate after this date.

Waiver Process

​Complete the request form in full, This includes name, title, date and signature in the Attestation of Compliance section.

The division only processes complete requests. Incomplete requests are void 60 days after receipt.​


​Attach proof that your facility qualifies for the waiver. This can be copies of the:

  • License,
  • Certificate,
  • Registration, or
  • Other evidence of other governmental agency oversight.

​Email the request and required attachments to BHD.MH.Applications@oha.oregon.gov.

​Upon receiving a complete waiver, the division will review all submitted material. The division may:

  • Respond with questions,
  • Request additional information or
  • Ask you to send a new request.

You must provide requested information ithin 14 days​. The request is not complete until you send all required forms and information.

Once the review is complete, the division will send a determination within 30 days. ​If the division denies the waiver request, you can apply for CBSH registration. Do this within 30 days of the determination notice.

​If approved, the waiver will remain valid unless or until the facility:

  • ​Is no longer licensed, certfied or registered by the agency identified in the approved waiver, or
  • Changes their business model.

​If the division has reason to believe the facility no longer qualifies for a waiver, the facility must submit a new waiver request or apply for CBSH registration.​
