February 22, 2024 Notice of Proposed Rulemaking Hearing

You may submit written comments to pharmacy.rulemaking@bop.oregon.gov. All written comments must be received by 4:30PM on February 22, 2024.

Proposes to repeal rules in Division 019 Pharmacist and Division 025 Certified Oregon Pharmacy Technician and Pharmacy Technician rules related to vaccinations effective 11:59PM on 2/29/2024. The board adopted Division 115 Pharmacists rules in August, October and December 2023, which replace Division 019. The board adopted Division 125 Pharmacy Technicians rules in August 2023 and December 2023 which replace Division 025. Divisions 019 and 025 need to be repealed effective at 11:59PM on 2/29/2024 to allow Division 115 and 125 rules to become effective at 12:00AM on 3/1/2024.

*Please note: The proposed rule repeals are being filed separately from the other Division 019 and 025 rule repeals due to limitations in the online rule filing system that would not permit the rules to be repealed until after amendments adopted by the board in December 2023 became effective on 1/1/2024.

Rulemaking Process

The purpose of a Rulemaking Hearing is an opportunity for the public and stakeholders to provide oral testimony or submit written comments on rules proposed by the Oregon Board of Pharmacy, it is not a board meeting; The board does not engage in discussion on proposed rules during a Rulemaking Hearing meeting, however the public may provide oral testimony during the hearing or submit written comments to pharmacy.rulemaking@bop.oregon.gov during the public comment period on the specific rules noticed for proposed rulemaking.

Please review the proposed rulemaking notices for the date and time of the hearing (typically 9:30AM), link to join virtually, phone number and conference ID# to listen to the hearing, public comment period, and special instructions which includes directions on how to sign up to provide oral testimony and where to submit written comments.

When the public comment period ends, a hearing report is presented to the board for their consideration at the next scheduled board meeting and includes a summary of oral testimony received during the hearing (if applicable) as well as all written comments received.
