Greenhouse Gas Reporting Program Fee Update 2026

This rulemaking proposes amendments to OAR 340 Divisions 216 and 220 to permanently adjust the fees assessed to air-permitted facilities subject to Greenhouse Gas Reporting requirements. 

Oregon's 2025 legislature authorized the commission to adjust the fees to support the current costs to operate the program. In July of 2025 temporary rules to increase these fees were adopted by the EQC. This rulemaking proposes to amend the rules so that the adjusted fees are permanent.

This rulemaking does not propose amendments to any program reporting requirements.

Oregon's Greenhouse Gas Reporting Program

Oregon's Greenhouse Gas Reporting Program rules require reporting from major sources of greenhouse gas emissions in Oregon. This includes industrial facilities, suppliers of liquid fuels and natural gas, landfills and electricity suppliers. DEQ receives data from more than 400 regulated entities across 120 industry types, supporting the statewide greenhouse gas inventory and programs such as HB 2021 Clean Energy Targets and DEQ's Climate Protection Program. 

Advisory committee

DEQ is convening an advisory committee to review the technical issues and fiscal impacts related to the proposed rules. In convening this committee, DEQ has appointed members that reflect the range of entities that are both directly and indirectly affected by proposed changes to the rules.

EQC action

At the 438th Oregon Environmental Quality Commission meeting on July 10, 2025, the Environmental Quality Commission authorized delegation to Director Leah Feldon for the Greenhouse Gas Reporting Program Fee Update 2026 rulemaking.
