Approved Facilities Under Construction:

Boardman Coal Plant – Review of Termination Request

The Department is conducting its review of the termination request, in conjunction/consultation with the Oregon Department of Environmental Quality and Oregon Public Utilities Commission staff. The Department will present its recommendations to Council for concurrence, modification, or rejection to terminate the site certificate, once all of the required information is received.

Buckley Solar Facility – Notice of Intent

The preliminary Application for Site Certificate must be submitted by August 16, 2026.

Carty Generating Station – Completeness Review (on hold)

The preliminary Request for Amendment (pRFA4) was submitted on February 16, 2024. The Department determined pRFA4 was incomplete on April 16, 2024 and sent requests for additional information (RAI). The Department anticipates RAI responses, and a second round of RAIs will be needed in Q2 2026.

Cascade Renewable Transmission System – Preliminary Application for Site Certificate (pASC)

The Department is drafting the Draft Proposed Order and coordinating with reviewing agencies on review of the pASC. Completeness review will continue through Q2 2026.

Deschutes Solar and Battery Energy Storage System (BESS) Facility  – Preliminary Application for Site Certificate (pASC)

The Department is drafting the Draft Proposed Order and coordinating with reviewing agencies on review of the pASC. Completeness review will continue through Q2 2026.

Heppner Wind Project – Notice of Intent

The preliminary Application for Site Certificate must be submitted by March 27, 2027.

Klamath Cogeneration Project  preliminary Request for Amendment #6

The certificate holder submitted the required property owner information on May 22, 2026. The Department sent the OAR 345-027-0360(2) required notice making the public aware of the receipt of the amendment request on May 28, 2026. The amendment request was also posted to the project website. The Department is reviewing pRFA6 for completeness.

Klamath Falls Energy Center – Notice of Intent

The Department issued the Project Order on May 11, 2026. The pASC must be submitted by December 2027.

Muddy Creek Energy Park – Notice of Intent

The pASC was submitted on May 19, 2026 and has been added to the project page. Memos will be sent to reviewing agencies for their review and comments and the Department will review for completeness.

Saddle Butte Energy Facility – Notice of Intent

The Department issued the Project Order on May 1, 2026. The pASC must be submitted by December 2027.

Speedway Energy Facility – Notice of Intent

The preliminary Application for Site Certificate must be submitted by October 2027.

Sunrise Solar and Storage Projects – Notice of Intent

The preliminary Application for Site Certificate must be submitted by February 27, 2027.

Sunstone Solar Project – Request for Amendment to Transfer

The Department issued Public Notice of receipt of the Request for Amendment to Transfer, notifying the public that the request had been received and of a comment period extending from May 29 through June 26, and of a June 26 public hearing. 

Council will conduct a public hearing the Request for Amendment to transfer at its June 26, 2026 meeting. Council will review comments and may make a decision at the June 26 meeting or subsequent meeting depending on comments received.

Umatilla-Morrow County Connect Project – Preliminary Application for Site Certificate (pASC)

Review of the pASC is on hold, pending the applicant’s evaluation of an additional alternative transmission line route, under review to determine if there is an alternative route with lessor impacts. The Department anticipates receiving an update from the applicant on potential alternative route in Q2 2026. 

Wheatridge Renewable Energy Facility East – preliminary Request for Amendment #2

The Department received and reviewed responses from the certificate holder to its information requests. The Department anticipates deeming pRFA2 complete, issuing a Proposed Order and conducting a public hearing on RFA2 and the Proposed Order in June 2026.

Wheatridge Renewable Energy Facility III – Final Order

Council reviewed and approved the draft Final Order as the Final Order at its May 15, 2026 meeting and granted issuance of a First Amended Site Certificate for Wheatridge Renewable Energy Facility III and an original site certificate for Wagon Trail Solar II.

The Department is awaiting countersignature by the certificate holders. Upon receipt, the Department will serve the Final Order and make available on its project webpage.

Yellow Rosebush Energy Center – Contested Case

Motions for summary determination (MSD) were filed by the applicant and Department on April 6, 2026. Petitioner filed a response to MSDs on April 20, 2026. The Department filed a reply to the petitioner’s MSD response on April 27, 2026. The Council appointed Hearings Officer must issue a ruling on MSDs by June 12, 2026. 

Rulemaking - Radioactive Transport Fees

The Energy Facility Siting Council has filed a Notice of Proposed Rulemaking with the Oregon Secretary of State for proposed updates to Oregon’s radioactive transport fee rules. EFSC is accepting public comments on the proposed rules through July 31, 2026.

Rulemaking - Compliance Rulemaking

The Compliance RAC held their third meeting on May 27, 2026. Once feedback has been received from the third RAC meeting, staff will present draft language to Council and request the direction to file a Notice of Proposed Rulemaking.

Rulemaking - Financial Expertise and Retirement Assurance

The second RAC meeting was held on March 4, 2026. Once additional internal research has been completed, staff will schedule a third RAC meeting, likely for early June.
