Approved Facilities Under Construction:

Boardman Coal Plant – Review of Termination Request

The Department is conducting its review of the termination request, in conjunction/consultation with the Oregon Department of Environmental Quality and Oregon Public Utilities Commission staff. The Department will present its recommendations to Council for concurrence, modification, or rejection to terminate the site certificate, once all of the required information is received.

Buckley Solar Facility – Notice of Intent

The preliminary Application for Site Certificate must be submitted by August 16, 2026.

Carty Generating Station – Completeness Review (on hold)

The preliminary Request for Amendment (pRFA4) was submitted on February 16, 2024. The Department determined pRFA4 was incomplete on April 16, 2024 and sent requests for additional information (RAI). The Department anticipates RAI responses, and a second round of RAIs will be needed in Q2 2026.

Cascade Renewable Transmission System – Preliminary Application for Site Certificate (pASC)

The Department is drafting the Draft Proposed Order and coordinating with reviewing agencies on review of the pASC. Completeness review will continue through Q2 2026.

Deschutes Solar and Battery Energy Storage System (BESS) Facility  – Preliminary Application for Site Certificate (pASC)

The Department is drafting the Draft Proposed Order and coordinating with reviewing agencies on review of the pASC. Completeness review will continue through Q2 2026.

Heppner Wind Project – Notice of Intent

The preliminary Application for Site Certificate must be submitted by March 27, 2027.

Klamath Cogeneration Project  preliminary Request for Amendment #6

When the Department receives the required property owner information a notice will be sent as required by OAR 345-027-0360(2) and the amendment review will commence with a public notification of receipt of the preliminary request for amendment.

Klamath Falls Energy Center – Notice of Intent

The Department is reviewing public comments and coordinating with reviewing agencies for the purpose of drafting the Project Order. The Project Order will be issued in May 2026.

Leaning Juniper IIB Wind Power Facility – Request for Amendment #4

The Department provided the Final Order and Fourth Amended Site Certificate to the new certificate holder, for execution, on April 3, 2026. Certificate holder indicated the transferee would sign the site certificate on May 1, 2026. The Department plans to serve the Final Order in May, following site certificate execution by the certificate holder.

Muddy Creek Energy Park – Notice of Intent

The applicant must submit the preliminary Application for Site Certificate on or before May 19, 2026.

Saddle Butte Energy Facility – Notice of Intent

The Department is reviewing public comments received on the NOI and is continuing to coordinate with state, local and Tribal governments on information and study requirements to be included in the Project Order.

The Department expects to issue a Project Order in May 2026.

Speedway Energy Facility – Notice of Intent

The preliminary Application for Site Certificate must be submitted by October 2027.

Sunrise Solar and Storage Projects – Notice of Intent

The preliminary Application for Site Certificate must be submitted by February 27, 2027.

Umatilla-Morrow County Connect Project – Preliminary Application for Site Certificate (pASC)

Review of the pASC is on hold, pending the applicant’s evaluation of an additional alternative transmission line route, under review to determine if there is an alternative route with lessor impacts. The Department anticipates receiving an update from the applicant on potential alternative route in Q2 2026. 

Wheatridge Renewable Energy Facility East – preliminary Request for Amendment #2

The Department determined pRFA2 to be incomplete and requested additional information be provided by May 1, 2026. The Department anticipates issuing a Proposed Order on RFA2 in Q2 2026.

Wheatridge Renewable Energy Facility III – Draft Final Order

The comment period on RFA1 and the Department's Proposed Order concluded on April 3. The Department and certificate holder responded to comments on April 10. One commenter submitted a reply to Department and certificate holder responses. Certificate holder provided sur-reply. The Department issued its Notice of draft Final Order and Draft Final Order on April 30, 2026.

Council will review the draft Final Order, public comments, and the Department's evaluation of comments at the May 15, 2026 meeting. 

Yellow Rosebush Energy Center – Contested Case

Motions for summary determination (MSD) were filed by the applicant and Department on April 6, 2026. Petitioner filed a response to MSDs on April 20, 2026. The Department filed a reply to the petitioner’s MSD response on April 27, 2026. The Council appointed Hearings Officer must issue a ruling on MSDs by June 12, 2026. 

Rulemaking Tribal Government

Staff presented draft rules for permanent adoption to Council at the April Council meeting, where they were approved.

Rulemaking - Radioactive Transport Fees

Staff will present draft rules and request that the Council authorize filing of the Notice of Proposed Rulemaking (NOPR) at the May 15, 2026 Council meeting. Should Council approve the filing of the NOPR, the public comment period will begin once the filing is complete.

Rulemaking - Modernization

Staff presented draft rules for permanent adoption to Council at the April Council meeting, where they were approved.

Rulemaking - Exemptions Rulemaking

Staff presented draft rules for permanent adoption to Council at the April Council meeting, where they were approved.

Rulemaking - Compliance Rulemaking

Once feedback has been received from the second RAC meeting in February, staff will schedule a third RAC meeting, likely for May.

Rulemaking - Financial Expertise and Retirement Assurance

The second RAC meeting was held on March 4, 2026. Once additional internal research has been completed, staff will schedule a third RAC meeting, likely for early June.
