Cost Growth Target Data Submission



Overview

The Oregon Legislature, through Senate Bill 889 (2019 Laws), has established the Sustainable Health Care Cost Growth Target Program within the Oregon Health Authority (OHA). The Cost Growth Target (CGT) Program sets a target for the annual per person rate of growth of total health care spending in Oregon. The program will use annual data submissions to report on health care spending in the state, identify potential cost drivers, and inform health care policy conversations. 

Data reporting is an essential part of the program’s ability to capture health care cost spending across the state. To ensure accountability mechanisms are in place, the Oregon Legislature passed, with bipartisan support, HB2081 (2021) establishing civil penalties for failure to report data to the program. HB2081 was signed into law by Governor Brown on May 21, 2021. 

Mandatory Reporters

Using the latest health insurance enrollment data from the Oregon Division of Financial Regulation, OHA identifies mandatory reporters based on the type of the organization, the number of lives it covers in Oregon, and the lines of business it operates. CGT mandatory reporters are payers and licensed third-party administrators with at least 1,000 covered lives in Oregon across all required lines of business (commercial, Medicare, and Medicaid; see OAR 409-065).

2021 Rulemaking

CGT reporting requirements were detailed in OAR temporary rules 409-065 which came into effect on Jun 2, 2021 (lasting 180 days). Initial rule content was developed with input from CGT TAG participants in spring 2021. Permanent rulemaking took place in Fall 2021 with feedback from participants of the CGT TAG and the opportunity for public feedback. A high-level schedule for permanent rulemaking is outlined below:
