DEQ Seeks Feedback on Title V Alternative Fee Structures

HB 3229 §6 requires the Oregon Department of Environmental Quality to evaluate alternative fee structures for Oregon's federal operating permit program. The Department is required to report back to the legislature by Dec. 31, 2023, on progress made toward: 

  • Identifying fee structures that require the owners or operators of facilities subject to the federal operating permit program to pay fees that are commensurate with the regulatory complexity of the facility or permit;
  • Reviewing the fee structures of other state and local government agencies that administer a federal operating permit program;
  • Soliciting and considering input from owners or operators of facilities subject to the federal operating permit program and program stakeholders; and
  • Ensuring that any recommended fee structures would result in fees that are sufficient to cover all reasonable direct and indirect costs of the federal operating permit program. 

DEQ hosted a Research on Title V Alternative Fee Structures webinar on Sept. 26, 2023 to report out on initial research and begin engagement with stakeholders. The presentation slides provide information on HB 3229 and the initial results of the research on alternative fee structures used by other states to fund their Title V programs.
