Pursuant to OAR 409-070-0042, any party to a proposed material change transaction may submit the HCMO-4: Determination of Covered Transaction Status to request that OHA determine whether such transaction is a covered transaction under ORS 415.500 et seq. and OARS 409-070-0000 to 409-070-0085. Submission of the HCMO-4: Determination of Covered Transaction Status form is optional.
The HCMO-4: Determination of Covered Transaction Status form and supporting materials are intended for state agency use and will not be publicly posted.
Effective July 1, 2026, in accordance with OAR 409-070-0042(6), OHA will publish the letter of determination at whichever happens first:
- No less than six months after the date of the letter of determination in the event that the transaction proceeds, is publicly available, but is not subject to review by OHA;
- Within one business day after receipt of a complete notice of material change transaction;
- Within one business day after the letter of determination is sent to the requesting entity if the transaction is otherwise publicly known; or
- within one business day after the letter of determination is sent to the requesting entity if the entity consents to such letter being published.
