Written Consent to Access Public Insurance (Medicaid)

The Individuals with Disabilities Education Act (IDEA) and the Family Educational Rights and Privacy Act (FERPA) requires school districts to obtain parental consent before disclosing information about a student in order to access public insurance (Medicaid).

  • The school district must provide a written notification to parent/guardian prior to asking for informed written consent the first time public insurance (Medicaid) is accessed.
  • Written notification must be provided to parent/guardian annually thereafter.
